Terms of Service

These terms are the agreement between you and KJR Digital Marketing ("PoolCleanBiz", "we") for use of the PoolCleanBiz software. By opening an account you accept them. Questions: hello@poolcleanbiz.com.

1. What the service is

PoolCleanBiz is business software for pool-service companies: recurring billing, card autopay, failed-payment recovery, scheduling and routing, field service reports, and repair estimates. It is a tool you operate. It does not perform pool service and does not supervise your technicians.

2. Your account

You must be at least 18 and authorised to act for your business. You are responsible for what happens under your account, for the accuracy of what you enter, and for keeping credentials secure. Tell us promptly at hello@poolcleanbiz.com if you believe an account has been compromised.

3. Fees

Subscription is $19.99 per month for the owner plus $10 per month for each additional user, billed monthly in advance. Every feature is included at every team size.

Separately, we charge a 1% platform fee on payments processed through the service, collected by Stripe at the time of the charge. This is our fee to you. It is never added as a surcharge to your customer, and you must not present it to them as one.

Fees are non-refundable except where required by law. We will give at least 30 days' notice by email before any price increase, and you may cancel before it takes effect.

4. Payments run on your Stripe account — we never hold your money

Card processing uses Stripe Connect. You are the merchant of record on your own Stripe account. Charges to your customers are made directly on that account and settle directly to you. PoolCleanBiz never receives, holds, controls, or has custody of your funds or your customers' funds at any point.

Your use of Stripe is governed by Stripe's own agreement, which you accept during onboarding. Chargebacks, refunds, disputes and payout timing are between you, your customer and Stripe. We are not a party to them and we are not a payment processor, a bank, or a money transmitter.

5. Your data is yours

You own everything you put into PoolCleanBiz — customers, properties, service history, photos, invoices. You grant us only the licence needed to host and process it in order to run the service for you. We do not sell it, do not share it between accounts, and do not use it to build lists. You can export your data at any time, and on cancellation you have 30 days to export before deletion.

Where the data concerns your own customers, you are the controller and we are the processor. Obtaining any consent your customers are owed is your responsibility.

6. What the software deliberately does not do

These are product decisions, not oversights, and we will not add them on request:

  • No chemical dosing advice. PoolCleanBiz records the readings and the chemical costs your technician enters. It never recommends a chemical, a quantity, or a corrective action. Where you configure an acceptable range, an alert states only the measured value and the bound you set. All treatment decisions are yours and your technicians'.
  • No holding of customer funds — see section 4.
  • No cardholder surcharging — see section 3.
  • No marketing blasts or automated review solicitation. Messages the service sends are transactional.
  • No selling or brokering of leads or customer lists.

7. Acceptable use

Do not use the service to break the law, to send unsolicited marketing, to store payment card numbers in free-text fields, to attempt to access another account's data, to probe or disrupt the service, or to resell it as your own product. Compliance with debt-collection, telemarketing and consumer-protection rules in your jurisdiction is yours — the guardrails in the software help, but they are not legal advice.

8. Availability

We aim for the service to be available and correct, but we do not promise it will be uninterrupted or error-free, and there is no formal uptime guarantee at this stage. We may change or discontinue features; if we remove something you rely on materially, we will give notice by email.

9. Disclaimers and limits

The service is provided "as is", without warranties of any kind to the fullest extent the law allows. We are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data.

Our total liability for any claim is limited to the greater of (a) the subscription fees you paid us in the 12 months before the event, or (b) one hundred US dollars. Nothing here limits liability that cannot lawfully be limited.

10. Ending the agreement

Cancel any time; the subscription runs to the end of the paid month. We may suspend or close an account for breach of these terms or non-payment, with notice where practical. Sections 5, 9 and 11 survive termination.

11. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Disputes go to the state or federal courts located in Florida.

12. Changes

We may update these terms. For material changes we will email account holders and update the date above before they take effect. Continuing to use the service after that means you accept the new terms.
